1. PARTIES

This membership agreement has been concluded between GETMEPIN. (hereinafter referred to as ‘GETMEPIN.COM’), whose company headquarters is located in KADIKÖY / ISTANBUL, and the member (hereinafter referred to as ‘Member’) of the website / mobile website / mobile application (hereinafter referred to as ‘Site’) whose rights belong to GETMEPIN.COM or whose usage rights are determined by GETMEPIN.

2. Rights and Obligations of the Parties

2.1. The Member shall use the Site in accordance with all relevant legal regulations, ethical rules and the terms written in all policies and texts specified on the Site and the purpose of the Site. 

2.2. The Member accepts that the personal information he/she has provided to the Site and updated from the My Account section is correct, up-to-date and belongs to him/her; otherwise, he/she accepts all administrative, legal and criminal liability. The Member is solely responsible for the security and confidentiality of his/her personal information, especially the user name and password information. 

2.3. In case of any dispute as to the person to whom the membership rights and obligations belong, the last person who paid GETMEPIN for a Service using the relevant membership account shall be deemed to be the owner of the membership account.

2.4. It is mandatory to be over 18 years of age for membership. In case the member provides misleading information in this regard, all legal, criminal, administrative and financial responsibility shall belong to the member. In addition, persons whose membership has previously been terminated or suspended for any reason or who have been completely prevented from accessing the Site cannot become a member of the Site.

2.5. Legal entities may only become a member through their legal representatives. In the event that membership or subsequent transactions are made unauthorised, the person who makes the unauthorised transaction is personally responsible for the transactions he/she has made. In the event that this situation causes any damage, the person making the unauthorised transaction shall be solely responsible for such damage. 

2.6. It is prohibited to use the Site or any Content for any purpose that is unlawful or violates the Agreement.

2.7. GETMEPIN has the right to change, update, terminate, partially and/or completely prevent the use of the Site address, brand, slogan, Content of the Site and Service at any time. GETMEPIN also has the right to transfer member information in case of change or update.

2.8. GETMEPIN keeps the Content accurate and up-to-date. However, GETMEPIN shall not be liable if there is a difference between the Content provided by GETMEPIN and the current situation.

2.9. GETMEPIN has the right to make unilateral changes to this Agreement at any time. The amendments shall become effective upon the publication of the current agreement on the website. 

2.10. The member periodically reviews the agreement in order to be aware of the changes and is deemed to have accepted the amended agreement with continued access to the Site despite the changes.

2.11. By becoming a member of the Website and/or making use of the Service, the member explicitly and freely consents to the processing and transfer of his/her personal data domestically and abroad in the manner and scope specified in the relevant clarification and explicit consent texts and the Privacy Policy. 

2.12. The rights arising from all kinds of legal legislation regarding the Content belong exclusively to GETMEPIN or are licensed use. 

2.13. The Member may not copy, modify, display, share, disseminate for any purpose, record, reproduce, process, distribute, market, rent, sell, make available for access/use by third parties and/or transmit to third parties all or part of the Site or the Content or use it in a different form by revising, adding or changing part of it or perform any similar activity. The member who acts otherwise shall be solely responsible for any damages that may arise.

2.14. The Member agrees that he/she shall not use or allow the Content to be used in a way that may harm the right and/or work owners and third parties and/or in violation of the legal legislation. 

2.15. The Member may not delete or remove copyright, trademark and all kinds of notes under the Law on Intellectual and Artistic Works on any copied or printed material related to the Site or Content; may not carry out the activities specified in Article 4.12.

2.16. The Website may contain links to other websites and/or other content owned/operated by third parties and not under GETMEPIN's own control. Providing a link does not mean that GETMEPIN supports the linked website or the person operating that website or any warranty statement and does not constitute a statement or warranty for the information contained in the link. GETMEPIN has no responsibility for the websites and their contents accessed through the links on the Site and any damages that may arise are the sole responsibility of the member.

2.17. GETMEPIN shall not be liable for any direct or indirect damages that may be incurred by users, members or other third parties due to all kinds of similar programs and software, including but not limited to viruses, malware, algorithms, trojans, which may be exposed due to access to the Site, use of the Site and Content or data and information provided in other ways or other behaviours. The Member agrees in advance that he/she will not make any claim from GETMEPIN due to these damages.

2.18. The Member is obliged to carry out the transactions performed on the Site in accordance with the purpose of the Site and the Content in a manner that will not technically damage the Site, the Service and the Content in any way.

2.19. The Member shall not use any automatic device, programme, algorithm, methodology or any similar or equivalent manual process, tool or equipment to access, obtain, copy, monitor, monitor, query, reproduce or bypass all or part of the Site or the Content or the systems or networks connected to the Site, GETMEPIN or the servers of service providers, any service offered on the Site, or to obtain or attempt to obtain any material, document or information by any means not provided through the Site. 

2.20. The Member agrees not to examine, try, load, scan, test the vulnerability of the Site or the system or network infrastructure connected to the Site, not to violate security or verification measures, not to prevent the proper operation of the Site or any transaction carried out on the Site. The Member shall not monitor the information belonging to any user of the Site and shall not prevent its secure use, and shall not attempt to gain unauthorised access to any part or feature of the Site or any system connected to the Site through hacking, password decryption or other illegal or unauthorised means.

2.21. In the event that GETMEPIN is not the seller of any service/product on the Website, GETMEPIN shall have the title of hosting provider in accordance with the Law No. 5651 on the Regulation of Publications on the Internet and Combating Crimes Committed through These Publications and shall only have the title of intermediary service provider in accordance with the Law No. 6563 on the Regulation of Electronic Commerce. 

2.22. The Member agrees that the Member is the buyer party and the Seller is the seller party in distance sales contracts for purchases from any Seller other than GETMEPIN on the Site. GETMEPIN is not a party to the contractual relationship in question; for this reason, only the Seller is exclusively responsible to the Member within the scope of the relevant legislation.

2.23. GETMEPIN has the authority to collect the service/product price on behalf of the Seller for the services/products that the member will purchase from the Seller in accordance with the regulations in the contract it has signed with the Seller. 

2.24. GETMEPIN is not obliged to accept the membership request of each applicant in accordance with the freedom of contract. GETMEPIN is not obliged to show any justification in case the membership request is not accepted.
